An Indian band should put its working rules in writing before the first release, paid gig or difficult departure. A useful band agreement identifies the members, the name and accounts they use, who can make decisions, how money is handled, and what happens to songs, recordings and access when someone leaves. It is not pessimism. It is how a creative team preserves the relationship when the stakes rise.

This is a practical checklist, not a substitute for advice from an Indian music or commercial lawyer. The Copyright Office explains that a work of joint authorship is created through collaboration where the authors’ contributions are not distinct, while different copyright interests can also exist around lyrics, music and recordings. Those distinctions are exactly why a band needs its own written record. Copyright Office, Copyright Act, 1957, section 2

Key takeaways

  • A band agreement covers the continuing group; a split sheet covers one song. Use both when you make original music together.
  • Decide control of the band name, email, social accounts, masters, gig income and expenses before anyone has to leave the group.
  • If a copyright assignment or licence is intended, the Copyright Act sets specific written-form requirements. Get tailored legal advice for any exclusive or long-term deal.

Why does an independent band need an agreement?

A band agreement answers questions that ordinary friendship does not: who is a member, what counts as a group decision, who can accept a show, and who owns the accounts that hold the audience. The Indian Copyright Office’s handbook says copyright can be assigned wholly or partly, but an assignment must be in writing and identify the work, rights, duration, territory and royalty or other consideration. Copyright Office, Handbook of Copyright Law

That does not mean every band needs to assign copyright to the group. It means casual language such as “the band owns everything” is often too vague to resolve a real question. A group may be dealing with separate things at once: a band name, a song’s composition, a recording, live-show income, a shared Instagram login and equipment that one member bought.

Write down the working deal while everyone is aligned. The document can begin as a plain-language memo for the band, then be reviewed and formalised by a qualified lawyer if the group signs a label, management, publishing, brand or distribution deal.

The goal is not to predict every conflict. The goal is to make the everyday decision-maker visible. A band that knows who can reply to a promoter, approve a poster or pay a rehearsal bill spends less creative energy on avoidable uncertainty.

What should the agreement say about the band and its name?

Start by naming the current members, their roles and the date the working arrangement begins. Then identify the band’s public name, email address, website domain, social handles, distributor account and shared cloud folders. The Copyright Act distinguishes copyright in different types of work; control of a name or a login is a separate practical issue that should not be left implied. Copyright Office, Copyright Act, 1957, sections 13–14

Decide what requires unanimous approval and what can be delegated. For example, a member can be authorised to answer routine venue enquiries, while changing the band name, adding a permanent member, accepting a recording deal or granting a long-term licence requires every current member’s written approval. The right rule is the one your group can actually follow.

Also state how access is stored. Use a password manager or a shared record with at least two trusted members able to recover the email and social accounts. A departing member should not be able to lock the remaining group out of its public channels, and the remaining group should not be able to erase a departing member’s credited work.

How are songs and recordings different in a band agreement?

One of the most important distinctions is between the song and the recording. A lyric, composition and sound recording can involve different contributions and rights. The Copyright Office defines a work of joint authorship as a collaboration where contributions are not distinct; that test may not describe every band song, especially where one person wrote a clear lyric or melody before rehearsal. Copyright Office, Copyright Act, 1957, section 2

Use a band agreement to set the group’s default process, then use a separate split sheet for each original song. The agreement can say that every new song gets a dated split sheet before release, and that no member may register, distribute or license a recording without the contributors seeing the proposed credits and terms.

Our song split-sheet guide for India explains the practical fields for a track-level record. It is deliberately narrower than a band agreement: it should not try to decide who keeps the band name, the merch stock or the social accounts if a member leaves.

Treat the recording session as a decision point, not only a creative one. Before exporting final files, list the performers, producer, lyricist, composer, recording costs, master owner and people who must approve a release. That five-minute record is easier to preserve than a memory after the song gets attention.

How should a band agree on money and expenses?

Your agreement should separate money the group earns from money an individual earns. A performance fee may be band income, while a member’s unrelated session work usually is not. Define what enters the shared pool: gig fees, merchandise, sponsorship, grants, advances or recording revenue. Then state what is deducted before any split, such as travel, crew, rehearsal, marketing, recording or equipment hire.

Do not use a vague “we will split fairly” clause. Instead, name the process: who receives payment, where it is recorded, how receipts are shared, how often members receive a statement, and whether members approve expenses above an agreed amount. Keep a basic expense log even when the money is small. It creates a habit that still works when the amounts grow.

For live shows, confirm the deal in writing with the organiser too. Our guide to pitching a band to music venues in India covers how to make the offer clear; the band agreement should explain who inside the group may accept the date, deposit and final terms.

What happens when a member leaves or the band pauses?

The exit section is the part bands postpone, and the part they are most relieved to have later. Define how a member gives notice, whether they may be replaced, which existing recordings and releases remain live, what happens to future income from work already created, and what access changes on the departure date.

Avoid pretending the agreement can rewrite a person’s actual authorship. A departing songwriter or performer may still need correct credit and payment under a separate song or recording arrangement. The group’s agreement should instead say how it will identify, preserve and administer those obligations. If the band intends a licence, section 30 of the Copyright Act says a licence by the owner of an existing or future work must be in writing; section 30A applies section 19’s requirements with adaptations. Copyright Office, Copyright Act, 1957, sections 30–30A

Write a realistic process for public communication as well. Who tells a booked festival? Can the band continue using the name? What photos and old live videos stay online? A dignified exit plan lets people move on without turning a credit or login into a hostage situation.

A practical band-agreement checklist

Use this as a discussion list with your band before asking a lawyer to prepare or review a formal document:

  • Current members, roles and the start date of the arrangement.
  • Band name, email, domain, socials, distributor and cloud-account access.
  • Decision rules for everyday bookings, major deals, new members and a name change.
  • Per-song split-sheet process, recording credits, master ownership and release approvals.
  • Fee collection, expense approval, receipts, statements and income splits.
  • Equipment ownership, insurance and what happens to jointly purchased gear.
  • Expectations for rehearsals, show commitments and use of the band’s public identity.
  • Departure, replacement, pause and dissolution process, including account handover.
  • A way to handle disagreement before it becomes a public argument.

Keep the signed version where every member can access it. Then revisit it when the band changes materially: a new member joins, the first master is licensed, touring starts, a company is formed or a large deal appears. For a contract involving exclusive rights, major money or a disagreement, get advice from a lawyer who can assess your actual facts.

Make the agreement serve the music

A band agreement is successful when nobody has to think about it during rehearsal. It gives the group enough clarity to keep making songs, improving the show and taking opportunities without leaving one person to carry the admin or another person to guess their rights.

Start small, be specific and write only what you genuinely agree. Kredl can help creative teams present their real collaborators and confirmed credits clearly. It cannot decide a band’s ownership or deal terms; those need to be agreed by the people making the work.

Frequently Asked Questions

Is a band agreement the same as a song split sheet?

No. A split sheet records who contributed to one song and the shares everyone agrees for that track. A band agreement deals with the continuing group: name, accounts, money, masters, decision-making and exits. The Copyright Act recognises joint authorship, but that does not automatically settle every practical band question. Copyright Office, Copyright Act, 1957, section 2

Do Indian bands need to put copyright assignments in writing?

If a copyright assignment is intended, section 19 says it is not valid unless it is in writing and signed by the assignor or authorised agent. It must identify the work and specify the rights, duration and territory, among other requirements. Get tailored legal advice before assigning rights. Copyright Office, Copyright Act, 1957, section 19

Who should control a band’s Instagram and email?

The band should decide this together and record it in writing. A practical setup gives at least two trusted current members recovery access, names the group-owned email as the account owner, and describes what happens to access if a member leaves. The important point is that the decision is agreed before a disagreement or departure.

When should a band update its agreement?

Review it when something material changes: a permanent member joins or leaves, the band begins releasing originals, a master is licensed, a company is formed, touring becomes regular or a significant deal is proposed. The Copyright Office notes that licences and assignments have written-form rules, so a serious rights deal should receive specific legal review.
