When a client pays less than the amount on your invoice because it has withheld TDS, the deduction is not automatically an extra fee or your final tax bill. It is a tax credit that needs a clean paper trail: know how the client classified the payment, keep the invoice and payment proof, collect the relevant certificate, and reconcile the deduction with Form 26AS before filing.

This guide is for India-based freelance musicians, producers, photographers, videographers, editors, designers, writers and other creative professionals who are paid by clients. It explains an operating process, not a tax opinion. TDS treatment depends on the payer, the contract, your entity and the facts of the job. Ask an India-qualified chartered accountant to confirm the classification for your work.

Key takeaways

  • TDS is money withheld by the payer and deposited as tax; your invoice, payment record and tax-credit record should agree.
  • Under the Income-tax Act, 2025, different qualifying payments can carry different section 393 rates and thresholds.
  • For non-salary TDS, Form 131 is the 2026 successor to the earlier Form 16A certificate.
  • Do not file a return based only on a client's email; reconcile tax credit against Form 26AS and fix mismatches early.

Price the scope clearly before you issue the invoice

Why did the client pay less than my creative invoice?

TDS means tax deducted at source. In the ordinary freelance scenario, the client pays you after retaining a tax amount, deposits that amount with the government, and reports the deduction. The amount withheld is relevant to your eventual income-tax position; it is not a reason to quietly reduce the agreed value of the work.

The current statutory table matters because its categories are fact-specific. Under section 393 of the Income-tax Act, 2025, a qualifying payment to a contractor under a contract can carry TDS at 1% for an individual or Hindu undivided family contractor and 2% for another contractor, subject to stated thresholds. The same table separately lists professional services, technical services, royalty and other payment types. Income Tax Department, Section 393

That does not mean every creative invoice is a contract payment at 1% or 2%, or that every creative is a professional-fee case at 10%. The right question for the client or their accounts team is: which provision, rate and basis are you using for this payment? Keep the answer with the invoice. Your accountant can then check whether the treatment matches the engagement.

A simple commercial habit helps: quote the project fee and applicable taxes separately, then ask the client to confirm its withholding process before work is delivered. That stops an unpleasant surprise from becoming a vague dispute after the invoice has been approved.

Which 2026 TDS rules are most relevant to freelancers?

The Income-tax Act, 2025 groups several common payment types in section 393. In its resident-payment table, it describes qualifying contract payments, professional fees, technical fees and royalty separately; the payer and the nature of the payment matter. Treat the table as a reason to get a classification answer, not as a DIY rate card. Income Tax Department, Section 393

What your client may call the payment What you should ask for Why it matters
Project, assignment or contract fee The agreement scope, legal payer name, TDS provision and rate Qualifying contract payments have their own statutory conditions and thresholds
Professional-service fee The basis for treating the engagement as professional services Section 393 lists professional fees separately from contract work
Technical-service fee The written description of the technical service and the client’s basis The table distinguishes qualifying technical fees from other professional-fee cases
License or royalty payment The rights being licensed, territory, term and payment basis A rights payment is not interchangeable with an editing, shoot or performance fee

The published 2026 table says qualifying contract payments under section 393 have thresholds of ₹30,000 for a single payment and ₹1,00,000 in aggregate, with a 1% rate for an individual/HUF contractor and 2% otherwise. It separately lists qualifying professional fees at 10% and qualifying technical fees at 2%, generally above the ₹50,000 threshold stated in that row. Those are statutory categories, not labels you should assign to yourself without advice. Income Tax Department, Section 393

If a client says, “We always deduct this way,” ask them to state the provision on the payment advice or certificate. If the project involves both a creative service and rights, do not collapse the distinction into an unexplained single line. Get a written scope and tax review before you sign.

What records should I keep for every paid creative job?

Keep one job folder, even for a small assignment. The folder makes it much easier to answer a client, accountant or tax portal later without rebuilding the story from chat messages.

Keep What it should show
Signed agreement, email approval or purchase order Scope, deliverables, payer, total fee, rights and payment terms
Your invoice Legal name, PAN/GST details where applicable, service description, amount and due date
Payment proof Amount received, date, reference and the payer account where visible
TDS communication The provision/rate the client says it used and the withheld amount
TDS certificate The deductor, deductee, payment summary and tax deposited details
Form 26AS record The tax credit information visible on the Income Tax Department portal

For non-salary TDS certificates, the department’s March 2026 note identifies Form 131 as the successor to the earlier Form 16A. It says the certificate includes details of the deductor and deductee, the payment and tax deducted, and the tax deposited to the Central Government account. The same note says Form 131 is due within 15 days from the due date for the corresponding quarterly TDS statement, with the calendar dates set out in the note. Do not assume a client will send it automatically the moment it pays you. Put a polite follow-up reminder in your project closeout process. How do I reconcile TDS with Form 26AS?

Start with the financial-year view, then compare each job. The Income Tax Department’s Tax Credit Mismatch service compares TDS, TCS and tax figures reported in an income-tax return with the amounts reflected in Form 26AS. Its guidance says a mismatch can be corrected by the taxpayer or by the tax deductor through a correction in the relevant TDS return or form. Use this practical sequence:

  1. Make a sheet of every invoice, amount billed, amount received and TDS stated by the client.
  2. Match each row against the payment advice and the certificate once it is available.
  3. Check the relevant tax-credit information in Form 26AS on the e-Filing portal.
  4. If a deduction is missing or wrong, send the client one clear note with the invoice, payment date, amount and mismatch.
  5. Ask the deductor to check whether a corrected TDS statement or return is needed. Keep the correspondence.
  6. Give the complete folder to your chartered accountant before filing your return.

The portal guidance is useful here because it avoids an unproductive back-and-forth about screenshots. It states that Form 26AS is part of the prerequisite information for the Tax Credit Mismatch service and that the service displays differences between your return and the Form 26AS record. Do not lose the deduction in the paperwork. For each creative job, reconcile the agreed fee, invoice, actual payment, client’s TDS record and Form 26AS. The objective is a traceable tax credit—not merely an invoice marked “paid.”

What should you say to a client before and after withholding?

Ask early and write plainly. It is reasonable to request the legal payer name, PAN where appropriate, TDS provision and rate, payment timing, certificate process and the finance contact. This is commercial housekeeping, not confrontation.

Before invoicing, you can write:

Please confirm the billing entity, the TDS provision and rate you plan to apply, and the contact for the relevant tax certificate after payment. I will include the project scope and invoice details required for your records.

If the payment arrives short, write:

I received ₹[net amount] against invoice [number]. Please confirm the gross amount, TDS amount, provision/rate used, and when the relevant TDS certificate will be available. I will reconcile it with my tax-credit records.

Do not ask a coordinator to solve a tax classification from memory. Give them the facts: your invoice, the agreement, the payment reference and the question you need answered. If the answer changes the net payout materially, pause the next step until your accountant has reviewed it.

A worked example—without guessing the right TDS category

Suppose a videographer agrees to a ₹50,000 project fee. The client pays ₹45,000 and says ₹5,000 was withheld. The freelancer should not conclude from the percentage alone that the treatment is correct, or that ₹5,000 is an additional project expense.

The practical response is to record the ₹50,000 invoice, ₹45,000 payment and ₹5,000 stated deduction; ask the client for the provision/rate and certificate timeline; then reconcile the credit against Form 26AS. A chartered accountant can decide whether the arrangement was classified correctly and how the credit fits the return. The Income Tax Department says the payer has a duty to deduct at the applicable statutory rate when the relevant conditions apply; it does not turn a generic example into advice for every freelance job. Income Tax Department, Section 393

That distinction protects both sides. You still need to manage cash flow on the actual money received. You also need a credible audit trail for the withheld amount, rather than accepting a vague “TDS adjusted” note as the final record.

Frequently Asked Questions

Is TDS an extra fee that a client can deduct from my project price?

TDS is a tax withholding mechanism, not a substitute for agreeing the project fee. The commercial question is whether your contract price is stated as gross, whether taxes are separate, and how the client will report the deduction. Keep the gross invoice and the net payment visible so your tax adviser can reconcile the credit.

Is every freelance creative payment subject to 10% TDS?

No. Section 393 lists different qualifying payments and rates, including contract payments, professional fees and technical fees. The correct treatment depends on the payer, the legal character of the work and other facts. Do not choose a rate from a blog post; ask the client for its basis and get advice from an India-qualified chartered accountant. Income Tax Department

What is the 2026 replacement for Form 16A?

The Income Tax Department’s March 2026 TDS-certificate note identifies Form 131 as the successor to the earlier non-salary Form 16A. The note describes Form 131 as carrying deductor/deductee details, payment and tax-deduction information, and tax-deposit details. Income Tax Department

What if the TDS amount is not visible in Form 26AS?

Start with the invoice, payment proof and certificate or written TDS details, then ask the payer’s finance team to check its reporting. The e-Filing portal says tax-credit mismatches can be corrected by the taxpayer or the deductor, including through correction of the relevant TDS return or form. Income Tax Department

Can I claim a refund of TDS?

Whether a refund is due depends on your complete tax computation, eligible credits, deductions and return—not only on one client payment. Keep the withholding records and discuss the position with a chartered accountant when preparing the return. Do not promise a refund to yourself or a collaborator based on an invoice alone.

Treat the tax trail as part of professional practice

Creative freelancers already track versions, approvals, credits and files. Apply the same discipline to money. Confirm the client’s withholding approach before delivery. Keep the invoice and payment proof. Collect the certificate. Reconcile the tax credit. Escalate mismatches in writing.

That process will not answer every classification question, but it gives you and your adviser the records needed to answer the right one. For the commercial side of quoting, start with how to price creative work in India, then use the freelance video-editor pricing guide to separate scope from guesswork.
